By using the Service, you represent and warrant that:

  • You are at least 13 years of age;
  • If you are under 18, your parent or legal guardian has reviewed and agreed to these Terms;

IF YOU ARE A PARENT OR GUARDIAN AND YOU PERMIT A MINOR TO USE THE SERVICE, YOU ARE FULLY RESPONSIBLE FOR:

  • Monitoring and supervising the minor's use of the Service;

  • Ensuring the minor complies with this Agreement.

We do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided personal information, we will promptly delete it. If you believe a child under 13 has provided personal information to us, please contact us immediately.

YOU AGREE TO INDEMNIFY AND HOLD HARMLESS RevelBoard FOR ANY CLAIMS ARISING FROM A MINOR'S USE OF THE SERVICE UNDER YOUR SUPERVISION OR WITH YOUR PERMISSION.

2. NATURE OF THE SERVICE AND ASSUMPTION OF RISK

RevelBoard IS NOT RESPONSIBLE FOR ANY INJURY, DAMAGE, OR LOSS ARISING FROM THE CONSUMPTION OF ALCOHOL OR ANY OTHER SUBSTANCE BY YOU OR BY ANY OTHER PERSON.

Social and Emotional Risks

YOU ACKNOWLEDGE THAT PARTY GAMES MAY LEAD TO:

  • Discussions, revelations, or social situations that could be uncomfortable or embarrassing;
  • Disclosure of personal information or secrets during gameplay;
  • Interpersonal conflict, disagreements, or hurt feelings among players;
  • Changes in relationships or social dynamics as a result of gameplay.

YOU ASSUME ALL RISK for any social, emotional, or relationship consequences that may result from playing the games or from information revealed during gameplay. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS RevelBoard AGAINST ANY AND ALL CLAIMS ARISING FROM COMMERCIAL OR PROFESSIONAL USE OF THE SERVICE.

No Addictive Design Claims

You acknowledge that the Service is designed for entertainment and social interaction. We make no representations about the frequency or duration of use that is appropriate for any individual. You are solely responsible for managing your own time and usage of the Service. RevelBoard shall not be liable for any claims related to excessive use, habit formation, or time spent using the Service.

3. USER CONDUCT

You agree to use the Service only for lawful purposes and in accordance with this Agreement. You agree NOT to:

  • Use the Service in any way that violates any applicable federal, state, local, or international law or regulation;
  • Use the Service to engage in any conduct that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable;
  • Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service;
  • Use any automated means to access the Service or collect any information from the Service;
  • Impersonate or attempt to impersonate RevelBoard, a RevelBoard employee, another user, or any other person or entity;
  • Use the Service in any manner that could disable, overburden, damage, or impair the Service;
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service.

4. INTELLECTUAL PROPERTY

Ownership

All content and materials comprising the Service, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof ("Content"), are the property of RevelBoard or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

Limited License

Subject to your compliance with this Agreement, RevelBoard grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for your personal, non-commercial entertainment purposes.

You may NOT:

  • Copy, modify, distribute, sell, or lease any part of the Service;
  • Reverse engineer or attempt to extract the source code of the Service;
  • Use the Service for any commercial purpose without our prior written consent;
  • Remove any copyright, trademark, or other proprietary notices from any Content.

5. PREMIUM ACCESS AND PAYMENTS

Premium Purchases

RevelBoard offers premium access for a one-time annual fee. If you purchase premium access:

  • Prices are listed in US dollars (USD). If you pay in another currency, the converted amount is shown at checkout before you confirm;
  • Payment will be charged to your chosen payment method upon confirmation of purchase;
  • Premium access is valid for one (1) year from the date of purchase;
  • Premium access does NOT automatically renew - you must manually purchase again if you wish to continue after your access period expires;
  • Premium access is activated immediately after a successful payment. By completing the purchase you request immediate delivery of this digital content and acknowledge that, where permitted by law, you waive any statutory right of withdrawal once access has been activated.

Payment Processing and Merchant of Record

Purchases are processed by Stripe and its affiliates through Link (purchases marked "Sold through Link"). For these purchases Link acts as the merchant of record: the charge appears on your statement as "LINK.COM*" followed by our name, Link calculates and collects any applicable sales tax, VAT or GST, and Link sends your receipt by email. Your payment details are entered only on Stripe's secure checkout page and are never collected or stored by RevelBoard.

Refund Policy

Because premium access is digital content that is delivered immediately, we do not offer refunds for change of mind, for unused access, or for dissatisfaction with the content. A refund may be granted if you request it within sixty (60) days of the purchase and:

  • you paid but premium access was not activated on your account and we were unable to resolve it;
  • the premium content is materially different from how it was described at the time of purchase; or
  • the payment was unauthorized or you were charged more than once for the same purchase.

To request a refund, email us at revelboardapp@gmail.com with the email address you used at checkout and your receipt number, or use the refund request option in your Link account at link.com. Approved refunds are returned to the original payment method and may take several business days to appear. Link's refund policy applies to purchases sold through Link and will control where this policy is more restrictive. Nothing in this policy limits any consumer rights that cannot be waived under the laws of your country of residence.

Price Changes

We reserve the right to adjust pricing at any time. Price changes will not affect existing premium access periods.

Service Discontinuation

We reserve the right to discontinue the premium service or the entire Service at any time. If we discontinue the service, existing premium access will remain valid until its expiration date, but no refunds will be provided.

No Guarantees of Satisfaction

Premium access provides additional game categories and features as described on the Service at the time of purchase. WE DO NOT GUARANTEE THAT YOU WILL ENJOY OR BE SATISFIED WITH THE PREMIUM CONTENT. Entertainment value is subjective, and what is enjoyable to one person may not be enjoyable to another. Your sole remedy for dissatisfaction with premium content is to discontinue use of the Service. No refunds will be provided based on subjective dissatisfaction with content quality or entertainment value.

6. SERVICE AVAILABILITY

No Uptime Guarantee

We do not guarantee that the Service will be available at all times. The Service may be temporarily unavailable due to:

  • Scheduled or unscheduled maintenance;
  • Software updates or upgrades;
  • Server issues or technical difficulties;
  • Internet connectivity problems;
  • Circumstances beyond our reasonable control.

WE ARE NOT LIABLE FOR ANY LOSS, DAMAGE, OR INCONVENIENCE RESULTING FROM SERVICE UNAVAILABILITY, REGARDLESS OF THE CAUSE OR DURATION.

Third-Party Dependencies

The Service relies on third-party services (including but not limited to hosting providers, payment processors, and authentication services). We are not responsible for any failures, errors, or unavailability caused by these third-party services.

7. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RevelBoard DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
  • WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE;
  • WARRANTIES THAT DEFECTS WILL BE CORRECTED;
  • WARRANTIES THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM RevelBoard OR THROUGH THE SERVICE, SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS AGREEMENT.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RevelBoard, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES;
  • DAMAGES RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
  • PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICE OR PARTICIPATION IN ANY ACTIVITIES SUGGESTED BY GAME CONTENT;
  • ANY INJURIES, DAMAGES, OR LOSSES ARISING FROM YOUR PARTICIPATION IN DARES, CHALLENGES, OR OTHER ACTIVITIES, WHETHER OR NOT SUCH ACTIVITIES WERE SUGGESTED BY THE SERVICE;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO RevelBoard IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. INDEMNIFICATION

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS RevelBoard AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, AND AFFILIATES FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, OR DEBT, AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY'S FEES) ARISING FROM:

  • Your use of and access to the Service;
  • Your violation of any term of this Agreement;
  • Your violation of any third-party right, including without limitation any copyright, trademark, property, or privacy right;
  • Your violation of any applicable law, rule, or regulation;
  • Any claim that your use of the Service caused damage to a third party;
  • Any injuries, damages, or losses you or any third party sustains as a result of participating in any activities, dares, or challenges, whether or not suggested by the Service;
  • Your participation in any physical activities while using or as a result of using the Service.

This defense and indemnification obligation will survive termination of this Agreement and your use of the Service.

10. ARBITRATION AND CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Agreement to Arbitrate

You and RevelBoard agree that any dispute, claim, or controversy arising out of or relating to this Agreement or the Service shall be resolved by binding arbitration, rather than in court, except that either party may seek equitable relief in court for infringement or misuse of intellectual property rights.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Arbitration Procedures

Arbitration will be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be held in the United States, in a reasonably convenient location for both parties.

Class Action Waiver

YOU AND RevelBoard AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

Jury Trial Waiver

YOU AND RevelBoard HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY.

Opt-Out

You may opt out of this arbitration agreement by sending written notice of your decision to opt out to: revelboardapp@gmail.com, within 30 days of first accepting this Agreement. Your notice must include your name, address, and a clear statement that you wish to opt out of this arbitration agreement.

Severability

If any portion of this arbitration section is found to be unenforceable, the remaining portions shall remain in full force and effect.

11. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.

For any claims not subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.

Any cause of action or claim you may have arising out of or relating to this Agreement or the Service must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.

12. CHANGES TO THIS AGREEMENT

We reserve the right to modify this Agreement at any time. If we make material changes, we will notify you by posting the updated Agreement on the Service with a new "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Agreement.

It is your responsibility to review this Agreement periodically. If you do not agree to the modified Agreement, you must stop using the Service.

13. TERMINATION

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach this Agreement.

Upon termination, your right to use the Service will immediately cease. All provisions of this Agreement which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

Please see our Privacy Policy for more information about these rights and how to exercise them.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under this Agreement where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters (earthquakes, floods, hurricanes, etc.);
  • Acts of war, terrorism, or civil unrest;
  • Government actions, laws, or regulations;
  • Epidemics, pandemics, or public health emergencies;
  • Failures of third-party services, including hosting providers and internet service providers;
  • Power outages or telecommunications failures;
  • Cyberattacks, hacking, or other security incidents beyond our reasonable control.

Entire Agreement

This Agreement constitutes the entire agreement between you and RevelBoard regarding the Service and supersedes all prior agreements and understandings.

Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver

The failure of RevelBoard to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer this Agreement or your rights hereunder without our prior written consent. We may assign this Agreement without restriction.

No Third-Party Beneficiaries

This Agreement does not create any third-party beneficiary rights, except as expressly provided herein.
